Federal Court Voids Lifetime Benefits for Balochistan Officials

The federal court has struck down lifetime benefits granted to former chief secretaries of Balochistan and their widows. The ruling also dismissed an appeal filed by the provincial chief secretary. As a result, the court declared that the government notification granting those extra benefits had no legal standing.

In a four-page order, Justice Aamer Farooq said any government action taken against the law is unjustified. He stated that existing law does not allow retired officers or their family members to receive such additional lifetime privileges. Therefore, the court ruled that the notification could not remain in force.

The court also made clear that pensions and post-retirement benefits can only be granted under existing legal provisions. According to the order, those benefits must follow established rules rather than administrative preference. Moreover, the ruling emphasized that public authorities cannot create financial privileges without clear legal authorization.

It further stated that the power to frame rules on pensions and retirement benefits belongs only to the Finance Department. The court said neither the finance minister nor the chief secretary has authority to independently approve such measures. Consequently, any decision made outside that legal framework becomes invalid.

The order also addressed approval given by the chief minister of Balochistan. The court said that approval was unlawful because the Constitution permits only those executive actions that do not conflict with existing legal restrictions. Therefore, the additional benefits could not be defended on administrative grounds alone.

Previously, the Balochistan High Court had already declared these lifetime benefits illegal. After that decision, the provincial government challenged the ruling before the federal court. Now, with the appeal dismissed, the judgment closes the legal dispute and reinforces that public benefits must remain within the limits of the law.
